How Much Of A Workers’ Compensation Settlement Should I Expect?

Question

When you have been injured on the job in sunrise or elsewhere in South Florida, you should begin taking steps to seek workers’ compensation benefits as soon as you can. Those steps include reporting your injury to your employer as soon as possible (and within 30 days from the date of the injury at the latest), and seeking medical care from an approved health care provider to begin treatment for your injury. Medical care for your workplace injury is covered by workers’ compensation, and the Florida workers’ compensation system also cna provide wage replacement benefits of up to 66 and 2/3 percent of your average weekly wage. Yet the system can also provide additional settlement benefits when you have a permanent disability.

A recent article in Forbes details the Florida workers’ compensation settlement chart for 2023, and our Sunrise workers’ compensation lawyers can tell you more about it.

Payment of Permanent Impairment Rating Benefits

The first chart that you should know about when it comes to payment of workers’ compensation benefits in Florida is the percentage of weeks you will be paid based on the degree or amount of your impairment, or your permanent impairment rating. Injured workers are typically given an impairment rating once they have reached what is known as maximum medical improvement, or MMI, which means that they cannot improve any further from their current condition. The degrees or amounts of impairment, along with the weeks of payment, are as follows:

  • 1 percent to 10 percent: two weeks of pay for every percentage point of impairment;
  • 11 percent to 15 percent: three weeks of pay for every percentage point of impairment;
  • 16 percent to 20 percent: four weeks of pay for every percentage point of impairment; and
  • 21 percent or more: six weeks of pay for every percentage point of impairment.
